1. Who we are
This website, tunigamers.com (the “Site”, “TuniGamers”, “we”, “us”), sells digital products including game activation keys, gift cards, software licences, in-game items and subscription codes (collectively, “Digital Products”).
By accessing the Site, registering an account, or placing an order, you agree to be bound by these Terms of Service (the “Terms”) together with our Privacy Policy, Refund Policy, Chargeback Policy, Acceptable Use Policy and Digital Content & Cancellation Rights. If you do not agree to all of them, do not use the Site.
2. Eligibility
You must be at least 18 years old (or the age of majority in your country) and legally able to enter binding contracts. By placing an order, you represent that you meet these requirements and that the payment method you use belongs to you and is authorised for the transaction.
3. Nature of the products
Digital Products are intangible, non-returnable goods. Upon delivery (display of an activation key, code, link or login credentials), the product is considered fully consumed and cannot be retracted, recalled or returned to inventory.
Region, edition, language, platform and activation method are stated on each product page. It is your responsibility to verify these details before purchase. See Region & Activation Disclaimer.
4. Pricing & currency
Prices are displayed in Tunisian Dinar (TND). When you pay using an international payment method (such as PayPal), the payment processor will convert the order amount into the currency required by your card or wallet at their exchange rate. We do not control or profit from currency conversion performed by third-party processors.
We may change prices at any time. The price applicable to your order is the price displayed at the moment your order is confirmed.
5. Order acceptance
An order is an offer to purchase. We reserve the right to refuse or cancel any order, in whole or in part, at our sole discretion, including but not limited to: pricing errors, stock unavailability, suspected fraud, sanctions violations, prior chargebacks, conflict with our Acceptable Use Policy, or unverifiable customer details.
If we cancel an unfulfilled order, your full payment will be refunded to the original payment method.
6. Delivery
A registered customer account is required; TuniGamers does not offer guest checkout. Digital Products are delivered electronically after payment is confirmed. Delivery is normally instant but can take up to 15 minutes while a confirmed order remains in Processing. Ready game keys appear under My Account → Game Keys, and a delivery email is an additional notification.
If a confirmed Processing order has not delivered the purchased item after 15 minutes, create a support request through live chat or the Contact Us page. This is an investigation trigger, not a promise that a payment under review or an unconfirmed payment will be fulfilled within 15 minutes.
7. Account security
You are responsible for keeping your TuniGamers credentials confidential. Notify [email protected] immediately if you suspect unauthorised access.
For an account product, follow the listing and immediately change the supplied password, linked email and recovery or two-factor settings when the product and platform permit it. TuniGamers cannot support a later compromise or loss-of-access claim when the customer did not complete the required security changes.
8. Anti-fraud measures
We operate automated fraud detection (IP analysis, payer-name verification, velocity checks, sanctions screening). Orders flagged as risky may be held for manual review or cancelled with a full refund. Repeated suspicious activity may result in permanent account suspension and a block on future purchases. 9. Intellectual property
All content on the Site (text, graphics, logos, images, code) is owned by TuniGamers or its licensors and protected by international copyright laws. You may view and print pages for your personal, non-commercial use only.
Brand names, game titles, platform logos and trademarks are the property of their respective owners and are used for identification only.
10. Disclaimer of warranties
The Site and the Digital Products are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We do not guarantee that any specific game, platform or service will remain available, accessible, or supported by its publisher after the key has been delivered. Publisher decisions (account bans, region locks, store closures, end-of-service) are outside our control.
11. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Site or any Digital Product shall not exceed the amount you actually paid for the specific order giving rise to the claim.
We will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profit, data, goodwill or reputation, even if advised of the possibility of such damages.
12. Indemnity
You agree to indemnify and hold harmless TuniGamers, its operators and partners from any claim, demand, loss or expense (including legal fees) arising from your breach of these Terms, your misuse of any Digital Product, or your violation of any law or third-party right.
13. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including supplier outages, payment-processor outages, internet failures, government actions, sanctions, war, pandemic, or natural disasters.
14. Changes
We may amend these Terms at any time. The current version is always published on this page with an effective date. Continued use of the Site after changes constitutes acceptance of the new Terms.
15. Governing law & jurisdiction
These Terms are governed by the laws of Tunisia. The courts of Tunis have exclusive jurisdiction over any dispute. If you are a consumer resident in the European Union, the United Kingdom, Switzerland or another country whose law grants you mandatory consumer protections, those mandatory protections continue to apply and nothing in these Terms removes them.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
